Terms and Conditions

1. Definitions

In these Terms and Conditions, the following definitions apply:

• "We," "Our," "Us" refers to Willow Pace, a senior residential facility located in Chiang Rai, Thailand
• "Resident" means an individual who has entered into a residence agreement with Willow Pace
• "Family Member" means the designated contact person or legal representative of a Resident
• "Services" refers to the residential living, meals, housekeeping, and support provided by Willow Pace
• "Agreement" means the residence agreement signed between Willow Pace and the Resident or their Family Member

2. Acceptance of Terms

By submitting an inquiry through our website, visiting our facility, or entering into a residence agreement with Willow Pace, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

You must be at least 18 years of age to enter into a binding agreement with Willow Pace. For Residents who require assistance, a Family Member with legal authority may enter into the agreement on their behalf.

3. Services Provided

Willow Pace provides residential living arrangements for seniors, including:

• Private or shared room accommodation (depending on selected residence level)
• Three balanced meals daily with accommodation for dietary needs
• Housekeeping and laundry coordination
• Access to common areas including lounge and garden spaces
• Daily check-ins and general support from staff
• Optional activities and social programs

Services vary by residence level (Everyday Comfort, Tranquil Garden, or Personal Retreat Suite). Specific services included in each level are detailed in the residence agreement.

4. Services Not Provided

Willow Pace is a residential boarding house and does not provide medical or nursing services. We do not:

• Administer medications or provide medical treatments
• Offer skilled nursing care or medical supervision
• Provide physical therapy, occupational therapy, or rehabilitation services
• Serve individuals requiring continuous medical monitoring

Residents requiring medical care should maintain relationships with their personal physicians and healthcare providers. Families are responsible for coordinating any necessary medical services.

5. Admission Requirements

To be eligible for residence at Willow Pace, individuals must:

• Be able to manage basic daily living activities independently or with minimal assistance
• Not require continuous medical supervision or skilled nursing care
• Not pose a safety risk to themselves or other residents
• Complete an intake assessment and provide necessary health information
• Agree to facility rules and community standards

We reserve the right to decline admission if we determine that we cannot adequately meet an individual's needs within our service scope.

6. Payment Terms

6.1 Monthly Fees: Residence fees are charged monthly in advance and are due on the first day of each month. Current rates are:

• Everyday Comfort Residence: ฿7,200 per month
• Tranquil Garden Residence: ฿20,500 per month
• Personal Retreat Suite: ฿45,000 per month

6.2 Payment Methods: Payment may be made by bank transfer, check, or cash. Late payments may incur additional fees as outlined in the residence agreement.

6.3 Deposit: A refundable security deposit equivalent to one month's residence fee is required upon move-in. This deposit will be returned within 30 days of departure, less any charges for damages or unpaid fees.

6.4 Rate Adjustments: We reserve the right to adjust monthly rates with 60 days written notice. Current residents will receive advance notification of any rate changes.

7. Termination and Departure

7.1 Notice Period: Either party may terminate the residence agreement with 30 days written notice. Fees are prorated based on the actual departure date.

7.2 Immediate Termination: Willow Pace reserves the right to terminate the agreement immediately if:

• The Resident's health or care needs exceed our service capabilities
• The Resident poses a safety risk to themselves or others
• Payment is more than 30 days overdue
• The Resident or Family Member violates facility rules or engages in threatening behavior

7.3 Departure Process: Upon departure, Residents must remove all personal belongings and leave the room in reasonable condition. The security deposit will be returned after final inspection and settlement of all accounts.

8. Resident Responsibilities

Residents and their Family Members agree to:

• Treat staff and other residents with respect and courtesy
• Comply with facility rules and community standards
• Provide accurate health and contact information
• Notify staff of changes in health status or care needs
• Maintain personal hygiene and keep living spaces reasonably tidy
• Pay all fees on time as outlined in the residence agreement
• Respect the privacy and property of other residents

9. Our Responsibilities

Willow Pace commits to:

• Provide services as outlined in the residence agreement
• Maintain clean, safe, and well-maintained facilities
• Treat all Residents with dignity and respect
• Protect Resident privacy and confidentiality
• Communicate openly with Residents and Family Members
• Address concerns and complaints in a timely manner

10. Limitation of Liability

Willow Pace provides residential living support but is not liable for:

• Medical conditions or health complications not related to our services
• Personal property loss or damage (Residents should maintain appropriate insurance)
• Injuries resulting from a Resident's own actions or health conditions
• Third-party services arranged by Family Members

Our liability is limited to the amount of fees paid in the six months preceding any claim. This limitation applies to the maximum extent permitted by Thai law.

11. Indemnification

Residents and Family Members agree to indemnify and hold Willow Pace harmless from claims, damages, or expenses arising from the Resident's conduct, failure to comply with facility rules, or provision of inaccurate information that affects the Resident's care or safety.

12. Privacy and Data Protection

Personal information collected during the residence process is handled in accordance with our Privacy Policy and Thai privacy regulations. For detailed information, please review our Privacy Policy.

13. Dispute Resolution

13.1 Informal Resolution: Disputes should first be addressed through direct communication with facility management. We commit to working collaboratively to resolve concerns.

13.2 Mediation: If informal resolution is unsuccessful, parties agree to attempt mediation before pursuing legal action.

13.3 Governing Law: These Terms are governed by the laws of Thailand. Any legal disputes will be resolved in the courts of Chiang Rai Province, Thailand.

14. Changes to Terms

Willow Pace may update these Terms and Conditions periodically. Changes will be communicated to current Residents and Family Members with at least 30 days notice. Continued residence following notification of changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms and Conditions, together with the signed residence agreement, constitute the entire agreement between Willow Pace and the Resident or Family Member, superseding any prior oral or written agreements.
